Texas homeowners still have the dubious distinction of paying the highest insurance rates in the nation – despite measures designed to lower rates and much worse weather losses in other states.
The Dallas Morning News reported recently that the homeowner insurance situation is not improving in Texas. Please read the entire article. Here is a very brief excerpt:
"A new study from the National Association of Insurance Commissioners released Monday showed that the average annual premium in Texas for the most common homeowner policy was $1,409 a year, considerably more than the nationwide average of $804. Florida was second at $1,386 – after a jump of 28 percent in one year – and Louisiana was third at $1,257."

I am pleased
to announce
that our

Consumer
Protection
Department
to better serve the
needs of our
clients. In
these
troubling
financial
times, all
of us have
to be
careful with
our money.
That means
we can't
afford to be
taken
advantage of
by credit
card
or mortgage
companies
that don't
follow the
letter of
the law.
The
Consumer
Protection
Department
will be
managed by
attorney
Kathleen
Munden. Ms.
Munden
graduated
from
Baylor
University
School of
Law in 1996,
and managed her
own law firm
in Fort
Worth for
ten
years. The
focus of her
practice was
consumer
law,
including
consumer
bankruptcy,
creditor
harassment,
credit
reporting
violations,
and mortgage
dispute
cases.
Ms. Munden
is
experienced
in
representing
clients
under both
Federal and
Texas
consumer
protection
laws,
including
the Fair
Debt
Collection
Practices
Act, the
Fair Credit
Reporting
Act, and the
Texas
Deceptive
Trade
Practices
Act. A
particular
area of her
focus has
been the
increasing
number of
disputes
between
consumers
and their
mortgage
companies,
where the
homeowner’s
payments may
not have
been
credited
properly,
escrow is
inaccurately
calculated,
or unjust
foreclosure
actions are
filed.
Due to the
current
difficult
economic
climate,
many
consumers
are finding
that
bankruptcy
protection
is their
best option
to preserve
their assets
and assure
their
family’s
financial
stability.
In 2008,
over one
million
bankruptcy
cases were
filed by
individuals
in the
United
States, and
there has
been a 37%
increase in
filings
during the
first two
months of
2009. Ms.
Munden has
filed over
700 consumer
bankruptcy
cases in the
Northern
District and
Eastern
District of
Texas, and
has
successfully
represented
her clients
in disputes
with
creditors
within those
bankruptcy
cases.
Many
consumer
disputes
with
creditors
can also be
solved
without
filing for
bankruptcy
protection,
and it is
often
possible to
work out a
favorable
debt
repayment
plan with
creditors
and avoid
bankruptcy.
Also,
consumers
can be
protected
from
creditor
harassment,
attempts to
collect
debts that
the
consumers do
not owe, and
inaccurate
credit
reporting
practices,
all without
the need to
file
bankruptcy.
It is also
possible
that if a
creditor has
violated
either
Federal or
Texas debt
collection
laws, a
consumer may
be entitled
to recover
damages and
attorney’s
fees from
the creditor
for that
violation.
Ms. Munden
has
successfully
recovered
thousands of
dollars in
such damages
for her
clients in
the past,
and looks
forward to
providing
assistance
to the
clients of

in such
cases.

The drug Avandia, manufactured by GlaxoSmithKline, is used to treat Type 2 diabetes by helping patients control their blood sugar levels. The drug has enjoyed phenomenal sales, with 60 million prescriptions written since 1999. However, if you have taken Avandia to control your diabetes, you should be aware this best-selling drug has been linked to serious, life-threatening side effects.
In May 2007, a New England Journal of Medicine study found that Avandia increased the risk of heart attacks by 43 percent. Two months later, an FDA panel acknowledged the elevated risk of heart attacks from the drug but decided to keep it on the market with a "black box" warning. Diabetics who have mild heart disease or problems with their kidneys are at an elevated risk of developing congestive heart failure.
Heart problems are not the only serious side effect from Avandia. Experiments by a Salk Institute researcher found that the diabetes drug actually promoted osteoporosis by slowing bone growth while also speeding up bone loss. That finding reinforced clinical studies that showed an increased risk of bone fractures among patients who took Avandia.
One of the most serious health effects associated with Avandia is the onset of primary pulmonary hypertension, or PPH. This is a rare condition that causes the narrowing of blood vessels and results in high blood pressure. PPH is a precursor to heart failure, and this risk is highest in patients taking insulin or medicines called nitrates. Patients who develop PPH face these dire consequences: Shortness of breath, dizziness, Fainting or loss of consciousness, heart failure, or even death.
Immediately contact your doctor if you have experienced any of the serious side effects associated with Avandia.

Arthritis: The
Most Common
Cause of
Disability
Individuals
filing for
disability often
have multiple
health problems.
The most common
of the physical
disabilities
lawyers see in
preparing
disability
claims is one or
more of the
various types of
arthritis. The
most common form
is
osteoarthritis
or degenerative
joint disease
that is the
result of either
age, infection,
or trauma to the
joint itself.
Rheumatoid and
psoriatic
arthritis are
autoimmune
diseases in
which the body
attacks its own
joints. Septic
arthritis
results from an
infection, and
gouty arthritis
causes crystals
of uric acid in
the joint

U.S. House of
Representatives
introduced
bi-partisan
legislation by
U.S. Reps. Anna
Eshoo (D-Calif.)
And Fred Upton
(R-Mich.) aimed
at assisting the
46 million
adults (1 in 5)
and 300,000
children with
arthritis. This
legislation is
supported by
both the
American College
of Rheumatology
and the
Arthritis
Foundation. The
Arthritis
Foundation is
the largest
private,
not-for-profit
contributor to
arthritis
research in the
world. Since
1948 it has
funded more than
$400 million in
research grants.
Around the
country each
year, the
Arthritis
Foundation holds
walks that raise
crucial revenue
to support
things like H.R.
1212. This May,
our firm will
participate in
the
Dallas Arthritis
Walk
sponsored by the
Texas Chapter of
the Arthritis
